The NBA legend Testifies He Felt No Fear of the Racing Body in Legal Battle

The basketball icon, introducing himself formally in a Charlotte court on Friday, admitted that his competitive side and novelty within the sport emboldened his push for 23XI Racing to “challenge” Nascar over alleged violations of antitrust rules.

Team Investment and a Will to Win

Jordan shared financial and corporate details of his racing venture, saying he invested $40m of his own funds into the Cup Series operation co-founded with business partner Curtis Polk and longtime driver Denny Hamlin.

“Someone had to step forward,” Jordan said in the Charlotte courtroom. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination from a different view.”

The Core Dispute: Franchise System and Renewal Demands

At issue is the end of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other professional sports with independent franchises, such as the NBA’s Hornets or the NFL’s Panthers. This deal was set to expire in 2024 when Nascar demanded charter membership renewals.

Jordan was on the witness stand for about sixty minutes and left the court to a media frenzy, with fans and media clamoring for a glimpse or a photo of the global icon.

Spearheading the Fight

Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is breaking the law to keep two hands on the wheel.

At issue for Jordan and Heather Gibbs, who preceded Jordan, are details from September 2024. Gibbs described a frantic and emotional six hours where the sanctioning body told teams they must sign a charter agreement extension. This agreement consists of over a hundred pages detailing pay for chartered teams and a guaranteed spot in Nascar-sponsored races.

Choosing Litigation

Jordan said that 23XI and Front Row Motorsports decided their only feasible option was to refuse a signature that extensive document and litigate the matter. The other 13 organizations agreed to the terms.

Jordan and co-owner Denny Hamlin approached Nascar about possible changes or negotiations. Nascar wasn’t talking, Jordan said.

The Ultimate Motivation: Victory

Ultimately, the pushback against what he saw as a financially unsustainable model was driven by the familiar goal for Jordan: Winning.

“Hamlin persuaded me getting a third driver improved our chances to win,” he said, sharing that he bought a third charter late in 2024 for $28 million despite the uncertainty. “So I took the plunge.”

Account from the Gibbs Family

Gibbs described her push for indefinite franchises, submitted in a written letter to Nascar. She testified the timing of the contract signing demand was problematic.

According to her, Joe Gibbs first tried to call and talk Nascar out of demanding signatures, but CEO Jim France declined the request.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s executives. The response was, “Whether I have 20 charters, that’s what I have. If I have 30, that’s the number.”
