Federal Court Orders Freedom of Abrego Garcia from ICE Detention
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.
"Since Abrego Garcia's return from erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her order.
The situation stems from a erroneous deportation to El Salvador earlier this year, which the government later admitted was an error. Following his return to the United States to face human smuggling allegations, he was held in federal detention.
In her order, the judge pointed out that the authorities does not have a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."

The court proceedings involve disputed assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this allegation.
